Terms of use

Short, because a long one would mostly be there to protect me from you rather than to tell you anything.

1. What this service does

Disclosemark writes disclosure metadata into image files you upload, generates disclosure text for you to publish, and hosts a transparency page at an address you choose. It records the declarations you make about your own images. It does not examine them and does not verify that what you have declared is accurate.

2. It is not legal advice

Nothing here — the documentation, the generated text, the metadata, this page — is legal advice. The generated disclosure text is a starting point written from a reading of published regulation and platform policy. Whether it satisfies your obligations in your jurisdiction, for your listings, is a question only a qualified lawyer can answer for you.

You are responsible for what you publish. If a marketplace removes your listing or a regulator takes an interest, that remains your matter, and using this service does not transfer any of it to me.

3. Your account

Sign-in is by emailed link, so whoever controls your email address controls your account. Keep it secure. One person per account; the Agency plan covers multiple clients, not multiple logins.

You may not use the service to make false declarations about content, to impersonate another person or business on a transparency page, or to mark content that is unlawful in the jurisdiction where you publish it.

4. Your content

You keep every right you have in the images you upload. I claim no licence over them beyond what is needed to run the service: storing them, processing them, and serving the ones you explicitly choose to list on your public transparency page.

Files uploaded on the free plan are deleted from storage 30 days after upload. On a paid plan they are kept while your account is open. Deleting an image in the dashboard removes both the stored file and its record.

5. Payment

Paid plans bill monthly in advance through Stripe. Prices exclude VAT, which Stripe calculates at checkout. Cancelling stops the next renewal; the current period runs to its end and is not refunded pro rata.

If a payment fails, Stripe retries over several days. Paid features stay on during the retries. If they all fail, the account returns to the free plan and nothing is deleted.

6. Availability

There is no uptime guarantee and no service credit. This is a small product run by one person. The status page reports live checks, and material incidents get written up in the changelog.

If I discontinue the service I will give at least 60 days' notice by email, and transparency pages will keep serving for that whole period. Files you have already downloaded are unaffected by anything that happens here, because the metadata lives in the file rather than in this service.

7. Liability

To the extent the law allows, my total liability to you for any claim connected with this service is limited to the amount you paid in the twelve months before the claim arose. For a free-plan user that is zero, which is an honest statement of what a free service can promise rather than a trick.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are unaffected.

8. Ending it

You can close your account at any time from the dashboard, which deletes your images, records and transparency pages. I may suspend an account that is breaching section 3, and I will tell you why.

9. Changes

If these terms change materially I will email account holders at least 14 days before the change takes effect. The date at the top of this page always reflects the current version.

10. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident elsewhere in the EU or the UK, this does not deprive you of the protection of mandatory local law.
